Lusk pleads guilty to rape, sodomy

When former Auburn Church of Christ pastor Jody Lusk turned himself in to police after running away with a 13-year-old girl, with whom he was having an ongoing sexual relationship, he said he would not fight any charges that were made against him.

Lusk finally made good on that promise Tuesday when he plead guilty to all 12 charges that he was indicted on.

The 12 charges came from six incidents when Lusk had sex with the young teen. Half the charges were for second degree rape (because the girl was too young to legally consent) and the others were for sodomy.

“The rape was for sexual intercourse with a minor and the sodomy comes from having oral sex with a minor,” Lusk said while being questioned by Judge Tyler Gill.

Lusk will get between five and 20 years in prison for pleading guilty.

Just how long he will get will be determined at his final sentencing hearing, which was scheduled for March 5.

Lusk’s attorney, Leilani Krashin, said she told him to expect the maximum sentence.

“I told him to expect that and anything less would be a gift,” Krashin said.

If he receives the minimum five-year sentence, Lusk could be out in less than a year because of the time he has already served since being arrested in September.

He will be eligible for parole after completing 20 percent of his sentence.

Even after being released from prison, Lusk will have to file as a sexual offender and could be on that list for the rest of his life.

Logan County Assistant Commonwealth’s Attorney Joe Ross said he expects a lot of testimony at the sentencing hearing – which could take up most of the day in court.

Ross also said that it is his understanding that Lusk could face federal charges once his this case is completed.

Federal investigators are looking at the case because Lusk transported the teenage girl across state lines.

Lusk turned himself in Friday, Sept. 6 after seeing he was wanted by the FBI on a television in a motel room in Morgantown.

Lusk said his intent was to run away with the teen but later changed his mind and returned her home after taking her out of state.

Lusk staged his disappearance at Briggs Lake Friday, Sept. 4 by vandalizing his own vehicle and turning his boat upside down in the lake before texting his wife a license plate number and the name of the lake. Lusk admitted he did that to buy time to get out of town with the youth.

Lusk will next be in court Oct. 1 for a pretrial conference.
