The deputies were told that Darly Sherley, 46, of Texas, was armed with a long gun, threatening suicide and would shoot responding officers. When two deputies arrived at 7563 Watermelon Road in Olmstead, Sherley was in a vehicle leaving. When the deputies tried to stop him, Sherley refused and ran into Deputy Shaun Embry's driver door as Embry was getting out of his cruiser. Embry, who was almost pinned against his car, fired one round into Sherley's vehicle to disable the vehicle.
Sherley stopped and surrendered without further incidence. Deputies seized a loaded 7mm Magnum rifle from Sherley's vehicle. Sherley was arrested for wanton endangerment, first degree (police officer) two counts; disregarding officers signal to stop; driving under the influence of alcohol/drugs; reckless driving; possession of open container, alcohol in a motor vehicle; possession of controlled prescription substance not in original container; non-illuminated license plate; and failure to wear a seat belt.
Sherley was lodged in the Logan County Detention Center on the felony, misdemeanor and traffic charges.
