Ricky D. McCarley, of Russellville, was indicted Feb. 22, 2013, by a Logan County Grand Jury on one count of rape, first degree; three counts of sodomy, second degree, victim under 14; one count of sexual abuse, victim under 14, first degree, and one count of sexual abuse third degree.
The commonwealth contends that McCarley committed rape, first degree when he allegedly engaged in sexual intercourse through the use of forcible compulsion; committed sodomy, second degree when he allegedly engaged in deviate sexual intercourse with another person who was less than 14 years of age when he performed oral sex on the victim; committed sexual abuse, first degree when he allegedly touched a 13-year-old in a sexual manner, and committed sexual abuse, third degree when he allegedly kissed the victim on the mouth.
